In September 2025, the European Union made one of the most significant regulatory moves in the modern history of nail care. Two ingredients found in the vast majority of gel nail products — HEMA and TPO — were prohibited from manufacture, sale, and professional use across all 27 EU member states, effective immediately. No sell-through period. No grace period for existing stock. Nail technicians across Europe were required to discard product they had relied on for years, often mid-supply cycle.
The ban does not apply in the United States. Neither HEMA nor TPO is currently restricted by the FDA. But that regulatory gap matters less than it might seem — consumer awareness and market pressure are already closing it, and the brands that repositioned early are gaining ground in 2026.

What Are HEMA and TPO in Gel Nail Polish?
These two ingredients serve different functions in gel products — and were banned for different reasons.
HEMA (2-Hydroxyethyl Methacrylate)
HEMA is a bonding monomer — a small molecule that helps gel polish adhere to the natural nail. It is present in the vast majority of gel bases, builder gels, and gel polishes. Its small molecular size is precisely what makes it effective and precisely what makes it risky: it can penetrate the skin barrier before the product cures, triggering sensitization in the immune system through cumulative repeated exposure.
The critical problem with HEMA sensitization is that it is irreversible. Once your immune system identifies HEMA as a threat, it will react to every future exposure — not just from nail products, but from dental bonding agents, medical adhesives, and contact lens solutions. European dermatologists have flagged HEMA as one of the fastest-growing occupational allergens in nail technicians. Clinical literature puts onset most commonly at two to five years of regular professional exposure, meaning many nail techs who have always been fine are still within the sensitization window.
TPO (Trimethylbenzoyl Diphenylphosphine Oxide)
TPO is a photoinitiator — the ingredient that triggers the curing reaction when gel is exposed to UV or LED light. Without it, gel will not harden. It is also responsible for the heat spike some clients feel during curing.
The EU classified TPO as a CMR 1B substance — presumed to be carcinogenic, mutagenic, or toxic to reproduction — based on animal studies where animals were fed large repeated doses. The EU's regulatory framework bans CMR 1B substances from cosmetics as a precaution, regardless of whether a risk assessment at real-world exposure levels would support the same conclusion. In this case, most cosmetic chemists believe it would not.
What Does the Science Say About These Ingredients?
The science differs meaningfully between the two ingredients, and it is worth being honest about that difference.
On TPO:
The animal studies cited in the ban involved animals being fed large, repeated doses — a completely different exposure scenario from trace contact during nail application. Cosmetic chemists have been consistent: at concentrations used in nail gel (0.5%–5%), with proper curing, real-world reproductive risk is extremely low. Once fully cured, TPO is locked into the hardened polymer and cannot be absorbed through skin. The EU ban reflects a hazard-based regulatory philosophy — if a substance can theoretically cause harm under any conditions, restrict it — rather than a determination that it causes harm in normal use.
On HEMA:
HEMA's risk profile is far less contested. It is a documented occupational allergen with a well-established sensitization mechanism. You can use gel products for years with no reaction, then develop a permanent allergy. Nail technicians face substantially higher risk than clients due to the frequency and duration of their contact with uncured product. Once sensitized, there is no reversal and no desensitization treatment. The allergy is permanent — and extends to other acrylate-containing products across medicine and dentistry.
What Does the EU HEMA & TPO Ban Mean in Practice?
For EU nail professionals, the ban was immediate and unsparing. Existing stock could not be used after September 1, 2025, regardless of when it was purchased. Salons had to dispose of product, restructure service menus, and train staff on new protocols — often under significant financial pressure with no transition time.
UK Timeline (Updated): A two-phase UK ban is now confirmed. New products containing TPO cannot be placed on the market from 15 August 2026. All remaining stock must be fully removed from sale and professional use by 14 February 2027. HEMA remains restricted to professional use only in the UK, with a wider HEMA review ongoing.
In the US, neither ingredient is currently banned. The FDA has not enacted restrictions, and based on the agency's risk-based regulatory philosophy, most cosmetic chemists consider a federal ban unlikely in the near term. California-level action remains a possibility but is not scheduled as of mid-2026.
EU Regulatory Reform Proposal — July 2025: In July 2025, the European Commission published a draft proposal to reform the legal framework underpinning bans like this one. If approved in 2026, the reform would require regulators to assess real-world exposure levels — not just hazard classification — before restricting an ingredient. Under that framework, both HEMA and TPO might be reviewed differently. The current ban is not expected to be reversed, but the proposal signals that Europe's regulatory philosophy is shifting toward the risk-based approach already used by the FDA. For brands and professionals, the practical takeaway is the same either way: being HEMA-free and TPO-free now keeps you ahead of the curve under any regulatory scenario.

The regulatory case for change in the US may be weak. The business and professional case is not.
Client Demand Is Already Shifting
The EU ban generated substantial mainstream media coverage — PBS, TODAY, and outlets well outside beauty trade press all covered it. US consumers read those headlines, and the questions are arriving at reception desks. Clients are actively searching for HEMA-free and TPO-free alternatives even without a domestic regulation requiring it. Salons that can confidently answer 'yes, everything we use is HEMA-free and TPO-free' are in a competitive position that salons still using conventional formulas are not.
Global Brands Are Already Reformulating
Because the EU ban applies globally to any product sold or used commercially in EU member states, global brands had to choose: reformulate once and maintain a single global formula, or run separate product lines per market. Most major brands chose global reformulation. OPI reformulated its entire Gel Color line as Intelli-Gel. Apres discontinued its original line and reformulated all shades. The market is moving whether US regulation follows or not.
The Occupational Risk Is Real, Regardless of Regulation
Regulatory status does not change the underlying biology.
